Terms of Service

Noonmark is in development and free to use. These terms say what that means in practice — what we provide, what you are responsible for, and what happens when something goes wrong.

Who you are agreeing with

Noonmark (noonmark.dev) is operated by a sole proprietorship established in the Netherlands. By creating a Workspace or posting to a Form you accept these terms. If you are accepting on behalf of a company, you confirm you may bind it.

What the service is

Noonmark gives each Form a URL that accepts a JSON object. We check the payload against the Form's Fields, store the Submission, show it in the Studio, and — where you turn them on — classify it, evaluate it at the Gate, and deliver it to a webhook you configure.

Except for the public page a survey Form gets, we do not render your screens. The interface your users see is yours to build and yours to answer for.

Accounts and Workspaces

You need an account to reach the Studio. Keep your sign-in details and your Form API keys to yourself: anyone holding a key can post to that Form, and anyone who can reach your Workspace can read its Submissions and its secrets.

You are responsible for what the people you invite to your Workspace do in it.

Your Submissions stay yours

You own what your Forms receive. You grant us only the permission needed to run the service for you: to receive, store, validate, classify, evaluate, display and deliver Submissions on your instruction. We do not sell your data, and we do not use your Submissions to train models.

For data protection purposes you are the controller of your Submissions and we are your processor. The privacy policy sets out how that works.

What you are responsible for

  • A lawful basis. You decide what your Forms collect. You need the right to collect it, and a privacy policy of your own that tells your users their data is processed by a provider on your behalf.
  • Sensitive data. Do not collect health data, government identifiers, payment card numbers, or data about children through a Form unless you have your own lawful basis and safeguards for it.
  • Lawful use. Do not use Noonmark to send, store or relay unlawful content, malware, or material that infringes somebody else's rights.
  • No abuse of the ingest. Do not use a Form to relay spam, to flood a third party, or to work around the rate limits — including by spreading the same traffic across many keys.
  • Your webhook. What your own service does with a delivery is yours to secure. Verify the signature before you act on one.

Limits

Ingest is limited to 20 requests a minute per IP address and 60 requests a minute per API key, with bodies up to 100 KB. Over the limit you get a 429 and a Retry-After header. We may change these limits, and we may apply a lower one to a Workspace whose traffic threatens the service for everybody else.

Availability

Noonmark is in development. There is no uptime commitment, no support commitment and no service level agreement. We may change, suspend or withdraw any part of it, and we will give notice of a material change where we reasonably can.

Webhook delivery is best effort: three attempts, no queue behind them. Treat the Submissions list as the record of what arrived, not your own webhook log.

Plans and payment

The service is free while it is in development, and plan limits — how many Forms, how many Submissions a cycle, how long they are kept — are set out in the Studio. We take no payments today. Before we charge anything we will publish prices and give you notice, and you will be free to stop.

Suspension and closing an account

You can stop using Noonmark whenever you like and delete your Forms and Submissions from the Studio. We may suspend or close a Workspace that breaks these terms, that puts the service or its other users at risk, or that we are required to act against.

Delete your Forms and Submissions from the Studio before you close an account, and export anything you want to keep first. Whatever is left when an account closes is removed by us, and you can ask us to remove it sooner at any time.

What we do not promise

The service is provided as it is. To the extent the law allows, we exclude implied warranties — that it will be uninterrupted, error-free, or fit for a particular purpose. Nothing here excludes liability that cannot lawfully be excluded, including for death, personal injury, fraud or intent.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits or revenue, or for lost or corrupted data. Our total liability is limited to what you paid us in the twelve months before the claim.

While the service is free, that amount is nothing. If a guaranteed outcome matters to your business, Noonmark is not yet the right place for it.

Changes to these terms

We may change these terms. Material changes will be announced on the site and the date at the top will change. Continuing to use the service after that means you accept the new version.

Governing law

These terms are governed by the law of the Netherlands, and disputes go to the competent Dutch courts. If you are a consumer, this does not remove protections the law of your own country gives you.
